In K and N Engineering, Inc. v. Bulat  the 9th Circuit decreed that if one elects statutory damages for a trademark counterfeiting claim, they cannot also recover attorneys' fees. This decision is contrary to other courts and, some argue, contrary to the purpose of the Lanham Act.
